Nintendo has begun to quietly ban 3DS owners’ devices from online services if they’ve hacked or modded their handheld. The remotely activated bans are hardware specific, meaning they’re limited solely to the modded 3DS and not a NNID, so there’s no worry of losing one’s digital library across Wii U or Switch. Banned 3DS owners are reporting that modded devices that have not participated in any form of piracy are also being included in the banwave.
The effects of the ban are, again, platform specific. That means that only the banned 3DS will feature disconnected online services. Funnily enough, the Nintendo eShop will continue to work on these banned handhelds, as well as the Miiverse. Everything else, from online multiplayer in all games to services like YouTube and web browsers, is disabled. That’s likely no bother to offline game players and homebrewers, but that’s no recompense to modders who enjoyed online multiplayer.
While the reactionary response to this banwave is to say Nintendo’s directly attacking the modding community, it’s likely Nintendo’s goal lies somewhere else. That the ban seems to be blanketed across as many modders as Nintendo could find is also telling. It shows that Nintendo’s either unwilling or unable to focus in their ban efforts on the specific offenders. If their tools are only able to report that a system has been modded, but they are aware that all cheaters and pirates must have modded their 3DS, then a straight ban on all modders is really Nintendo’s only course of action. It’s not fair to homebrewers, but it could be worse. Nintendo could likely have easily banned NNIDs too.
In the meantime, parts of the homebrewer community are discussing whether the banwave justifies any legal action based on a previous legal precedent set regarding iPhone soft-mods not breaking warranty. Others are considering how Nintendo managed to discover modders in the first place, believing it might be related to having SpotPass or the option to share data with Nintendo enabled. Nintendo is unlikely to comment on the banwave, but will likely continue to do similar banwaves in the future.

Just a few months after we brought Minecraft to Nintendo Switch, we're double-dipping with the big N to bring the game to the New Nintendo 3DS series. Whatever next, an N64 port? Get on it, Jens!
We want to stress that the game is only on the New Nintendo 3DS series, and we've used all the technical might of the dual-screened wonder machine to give you world sizes of 2016x2016 and 128 blocks high! Multiplayer won't be available at launch but we'll have more to share on the feature later. This edition's closest equivalent is 0.15.4 of Minecraft: Pocket Edition, and we'll be continuing to update from there!

Nintendo, like all gaming companies, wants you to buy its hardware and lots of games. Anyone deciding to modify or hack hardware to play pirate games, run emulators, or use a system for homebrew development does so at their own risk, and right now, that risk is a ban for 3DS owners.
Reports are appearing across multiple forums, including GBATemp and Reddit, that Nintendo is clamping down on modified 3DS hardware and blocking access to online services. Those affected are seeing 'Error Code: 002-0102' appear at the top of the lower 3DS screen along with a message stating online services are restricted. It doesn't matter what model of 3DS you own, the ban applies to any and all models Nintendo detects as having been modified.

Kotaku got in touch with Nintendo and was told the bans are in response to, 'unauthorized system modifications, playing unauthorized versions of one or more games and/or connecting to the game servers in violation of our terms of service.'

The ban apparently blocks access to playing games online and accessing services such as Miiverse. The eShop is still accessible, but apps such as YouTube are blocked. A banned 3DS can still be used to play games offline, but a new 3DS will be required to play online again.
According to a post on GBATemp by user PF2M, Nintendo collects information every time you connect to its online services to play games, run apps, etc. This information collection is ongoing and hasn't really been used for much until now. But PF2M believes Nintendo decided it was time to start using the data, and that 'Nintendo knows all.' So if you have a modified 3DS and don't want to get banned, either remove the modification or don't access Nintendo's servers.
